Q: If I discover a defect in my recently purchased home that was undisclosed during the purchase process, am I entitled to compensation from the seller?
A: Sellers of residential property must disclose “latent defects” of which the seller has actual knowledge. To establish seller’s liability for nondisclosure of a latent defect, the buyer must prove that the seller knew and failed to disclose a defect that is (1) material; (2) would not be expected to be observed by careful visual inspection of the property; and (3) poses a direct threat to the health or safety of the buyers.
